This Privacy Policy applies to your access and use of the Dalup Modern Indian Online Services, including use of our websites, mobile applications, satisfaction survey, loyalty program, stored value cards and other Online Programs (hereinafter, “DMI Online Services”). By downloading or using any of the DMI Online Services you are agreeing that you have read and agree to be bound by this Privacy Policy. If you disagree with any part of this Privacy Policy then please do not use any of the DMI Online Services.

We want you to enjoy every visit to dalup.com, whether you’re there to look around, join our loyalty program, or tell us about your last trip to one of our shops, as well as every experience with DMI Online Services.  We do collect information about you and we may share that information with third parties in certain circumstances, so please read on for more details about how we use personal information we collect about you when you use the DMI Online Services.

Who We Are

Dalup Modern Indian is part of Dalup Modern Indian. We are responsible for collecting your personal information, using it and protecting it. Dalup Modern Indian controls and operates its business and the DMI Online Services from within the United States of America.

Our online privacy practices are governed by the laws of the United States, which may differ from privacy laws in your state or home country.  The data that we collect from you may be transferred to, and stored at, a destination outside the American Territory. By submitting your personal information to us or our agents, through the use of the DMI Online Services you consent to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. We may change our Privacy Policy, for which we will place an ad on our website; so please check this page from time to time, as your continued use of the DMI Online Services after we publish our changes indicates your acceptance of any changed terms.

What Kind of Information We Collect?

Whether accessing the DMI Online Services form your home computer, from your smartphone or your tablet, Dalup Modern Indian and its agents (hereinafter, the Responsible) may collect some information that identifies you or relates you as an individual, such information is:

  • -Date of birth

  • -Mailing address

  • -Phone number

  • -Cellphone number

  • -Device ID, including IP address (whether it’s your computer’s, tablet’s  or smartphone’s IP),

  • -Geolocation (if using a mobile application your consent to providing it) and

  • -Ticket number

If you are applying for a franchise, we will need additionally your contact and employment information.

What Additional Information We Collect

The responsible collects additional information that does not reveal  your identity or that does not relate directly to you or any other individual. Such information is as follows:

  • -browser and device information, including operating system

  • -mobile application usage data

  • -aggregated information such as “click stream” information such as entry and exit points for the DMI Online Services (including referring URLs or domains), certain DMI Online Services traffic statistics, page views, and impressions

  • -information collected through cookies, pixel tags and other technologies described in more detail later on

In addition, when users request pages on the DMI Online Services, our servers automatically log the IP address of the particular user.  The IP address is a unique number assigned to your computer in order to identify it whenever you are surfing the Web.

How We Use The Personal Information We Collect

We use Personal Information about you for the following purposes needed for the service you are requesting:

  • evaluate the services offered by the store you visit;

  • process and manage the use of our services, including geolocation information in respect to our ‘Store Locator’ functionality;

  • respond to your inquiries or requests, and to post your comments or statements on message boards or in our online forums;

  • create and deliver personalized promotions, by combining your Personal Information with Other Information, such as the amounts and types of purchases you make and benefits you receive;

  • communicate with you by mail, telephone, facsimile, e-mail, mobile alerts and SMS text messaging about Dalup Modern Indian or our sister brand Baskin-Robbins, including about your orders or purchases, your services, accounts, contests you entered into, your requests for information, and to update you about changes to the DMI Online Services;

  • communicate with you, including by mail, telephone, facsimile, e-mail, mobile alerts and SMS text messaging, in connection with our marketing efforts;

  • allow you to send communications or benefits to friends or family through the DMI Online Services. By using this functionality, you acknowledge and agree that you are permitted to use and provide us with your friend’s or family’s name and e-mail address;

  • allow interoperability with social media and other third party sites. When using this functionality you should consult the privacy policy of such sites to determine the information practices of those sites;

  • further our business purposes, such as to perform data analysis, audits, fraud monitoring and prevention, to enhance, improve or modify the DMI Online Services, to identify usage trends, determine the effectiveness of our promotional campaigns and to operate and expand our business activities; and

  • Assist in the assessment of your application for a Dalup Modern Indian franchise.

We may send “transactional or relationship” communications to you, such as notices to facilitate a transaction you have conducted or messages that provide information about your existing account, using various electronic communication, including email and mobile communications.  You must opt-in to receive email and mobile communications (other than “transactional or relationship” communications referenced above), including SMS text messages from Dalup Modern Indian. Any opt-in will be subject to this Privacy Policy and we'll only email you, send you mobile alerts or SMS text messages if you opt-in to receive them from us.  If, at any time, you decide you would rather not receive these types of communications from Dalup Modern Indian, you can opt-out by clicking the unsubscribe link at the bottom of any Dalup Modern Indian email or by sending an email to sam@glenwoodsystems.com with the headline “DATA LIMITATION” followed by your full name, email address and cellphone number.

If you disagree with the purposes of the collection of data, you have up to 5 (five) days after using the website or mobile application to send an email to sam@glenwoodsystems.com with the headline “DO NOT USE MY PERSONAL INFORMATION” followed by your full name and email address; if after 5 (five) days you do not send the email, it will be understood as accepting the said purposes.

How We Collect The Information

The collection of the personal information will be done,  as follows:

  • -Via e-mails and by visiting our stores;

  • -When you call Dalup;

  • -By using the Dalup Modern Indian Webpage;

  • -By filling in voluntarily the requested information in the dialog windows opened by the webpage;

  • -By using the “autofilling” information tool;

  • -By direct collection; and

  • -Through public available sources and other available sources.

All the Information we collect about yourself can be combined to help us adapt our communications to you and develop products and services that meet your needs and expectations.

How We May Disclose Personal Information We Collect

Your privacy is very important to us.  We generally won’t disclose your Personal Information to anyone outside of Dalup Modern Indian or our sister brand Baskin-Robbins, except in the following circumstances:

Service Providers

We may disclose your Personal Information to third-party service providers to provide us with services such as website hosting, professional services, including information technology services and related infrastructure, customer service, e-mail delivery, auditing and other similar services.


We may disclose personal Information to our parent company and its affiliates (“Affiliates”) for the purposes described in this Privacy Policy, including for marketing purposes and to process inquiries and comments so as to provide our consumers with the superior product and consumer experience that our customers have come to expect from us around the globe.  Affiliates are those companies that are under common control of our parent company.

To Perform Services You Request

We may disclose your Personal Information to third parties in order to perform services you request or functions you initiate, when you post information and materials on message boards, forums and on the social networks.   When you post information in a public forum it becomes public information. In addition, we may disclose your Personal Information in order to identify you to anyone to whom you send communications through the DMI Online Services, including through our gifting program.

Corporate Transactions or Events

We may disclose your information to a third party in connection with a corporate reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings.

Franchise Applications

Finally, we may disclose the personal information you submit on a franchise application to our business units, agents, parent company, Affiliates and to third parties as part of our consideration of that application and to help conduct our franchise marketing efforts.  We require our agents to respect our privacy practices and not use your personal information for purposes other than to carry out our instructions.

By using the webpage or the mobile application, you are accepting the sharing of your personal information. If you do not express your disagreement with the transferring of your personal data, it will be understood as accepting it.

Children’s Online Privacy

Dalup Modern Indian recognizes the importance of protecting the privacy of children.  We will not knowingly collect any personally identifiable information from children under the age of thirteen (13).  When a user discloses personal information on the DMI Online Services, the user is representing to us that he or she is at least thirteen (13) years of age.

If a child under the age of thirteen (13) has provided us with personally identifiable information through the DMI Online Services, we ask that a parent or guardian e-mail us at sam@glenwoodsystems.com with the headline: “MINOR” followed by the child’s full name,, and we will delete the child’s information from our records.

How to Exercise your ARCO Rights

You are entitled to know what information we have about yourself, what do we use it for and the terms and conditions we have for them (Access). Moreover, you have the right to request the amendment of your personal information if it is not up-to-date, incomplete or inaccurate (Rectify); as well as to request to delete it from our records when you think it is not being used accordingly to our policy and the law (Cancelation); so as to oppose to the use of your personal information for specific activities (Objection). These rights are commonly known as ARCO Rights.

The procedure that has been applied to exercise such rights has been through the submission of the request by sending an email to sam@glenwoodsystems.com with the headline “ARCO RIGHTS”.

Your request has to include the following information:

  • -Which right you wish to exercise

  • -Copy of an official ID

The period to respond to the request is of 20 (twenty) working days.

What if I no longer agree

If you no longer agree with the Privacy Policy and you wish to revoke your consent send an email to sam@dalup.com with the headline “WITHDRAWAL OF CONSENT” along with your full name. Up to 20 (twenty) days after you will receive an email confirming that you have been eliminated from our lists.
